General Requirements

Advertorial Theme Landing Pages

Advertorial theme LP’s must have the following disclosures:

  • The term "ADVERTISEMENT" appears clearly and conspicuously at the top center in a manner unblocked by pop-up notices. This term shall be in capital letters, the font no less than 14 point size or 19 pixels, the color contrast ratio no less than 4.5* according to the World Wide Web Consortium’s Web Content Accessibility Guidelines (WCAG 2.0) section 1.4.3.
  • The phrase "THIS IS AN ADVERTISEMENT AND NOT AN ACTUAL NEWS ARTICLE, BLOG, OR CONSUMER PROTECTION UPDATE." appears clearly and conspicuously at the beginning of any disclosures at the bottom of the advertisement (or, in the absence of any disclosures, at the bottom of the advertisement alone). This phrase shall be in capital letters, the font no less than 20 point size or 27 pixels, the color contrast ratio no less than 4:5* according to the World Wide Web Consortium’s Web Content Accessibility Guidelines (WCAG 2.0) section 1.4.3.
  • Color contrast ratio can be tested using this tool by placing the Hex codes of the colors used in the box: http://snook.ca/technical/colour_contrast/colour.html

Advertorial theme LP’s must not have:

  • Any reference or image of a news reporter, article writer, news format or first person depiction of using a product or service that is not verified as authentic:
    Examples of what will be flagged:
    • references to or images of health or consumer writers, reporters, newscasters, sets of tv news shows;
    • headings or other references with words such as "news," "channel _," "times," "sentinel," "reporter," "byline" "Editor," "Editor’s Note," "Special Report."
    • First person accounts of using a product or service such as "Nutrition writer Jane Doe put Product X to the test" or "I used product X."
  • Misleading links, such as Facebook branded links which don’t go to Facebook.
  • Use of the word "consumer" in a heading, title or URL.
  • False comments
    Examples of what will be flagged:
    • Updated dynamically via javascript
    • defaults to current or recent date
    • are static and always current or recent date
    • are static and look like Facebook comments with no actual link back to Facebook

Billing

Convert2Media doesn't allow billing or pricing models that aren't transparent to users. This transparency must be present during the checkout process and clearly tell users how they'll be charged.

Requirements

  • Your billing terms and conditions must be clear and conspicuous to users.
  • Your billing terms and conditions cannot just be provided via a link.
  • Your prices and billing methods must be easily located on your website and obvious to users. In cases of recurrent billing or subscriptions, the price and billing interval must be present in a clear and obvious location on the page where users provide their information, and you must have an opt-in box. Providing prices and billing information in very small print on your website isn't considered obvious to users.

Celebrities

Convert2Media doesn't allow the use of an image or likeness of a celebrity without evidence or verification of their consent.

Child Pornography and Related Content

Convert2Media doesn't allow the promotion of child pornography, underage-themed pornography, non-consensual sex acts, or illegal sex acts. Please note that we don't allow this content even if the site might comply with government regulations surrounding this kind of advertising.

Children

Convert2Media doesn't allow the use of an image or likeness of a child in a manner that is not consistent with the product or service being advertised.

Claims

Your ads should be truthful, accurate, and up-to-date every time they're shown to users. Advertiser claims include but are not limited to:

  • competitive claims
  • superlatives
  • offers
  • discounts
  • pricing

This policy also covers unverified offers and claims that are either scientifically impossible, or otherwise misleading to users. For requirements related to specific product types see Weight Loss and Non-Weight Loss Health. For requirements related to specific website themes, see Advertorials.

  • All advertising claims must be factually supportable.
  • All discounts and offers in your ad must be up-to-date and must match the content on your website.
  • All advertised products, prices, offers, and discounts must be available on your site, at most two clicks away from your landing page, or through a basic search on your site.
  • Users must be able to perform the ad's call to action – if any – on the site, within 2 clicks of the landing page.
  • Any pricing information in ads must comply with local regulations concerning inclusion of tax and other applicable charges.

Copyright

Convert2Media doesn't allow the copying or distribution of copyrighted material unless you have consent from the copyright holder, or are otherwise permitted by law. A copyright is a form of protection provided by the laws of the United States to authors of "original works of authorship." This includes literary, dramatic, musical, artistic and certain other creative works.

Conunterfeit Goods

Convert2Media prohibits the sale or promotion of counterfeit goods. Counterfeit goods contain a trademark or logo that is identical to or substantially indistinguishable from the trademark of another. They mimic the brand features of the product in an attempt to pass themselves off as a genuine product of the brand owner.

Escort and Related Services

Convert2Media doesn't allow the promotion of escort services, prostitution, or other sexual services.

False Geo-Targeting Claims

Convert2Media prohibits the use of false geo-targeting claims inlcuding, but not limited to:

  • "[Location] Mom"
  • "[Location] Journal/News"
  • "[Location] Byline article"
  • "[Location] power companies hate him"
  • "3 Positions Left in [Location]"
  • "Stores in [Location] are sold out"

The claim must be verified as true or the advertisement will be denied.

False Limited Supply and Time Claims

Convert2Media does not allow false limited time and supply claims inlcuding, but not limited to:

  • Promotion expires on X date where X date is updated regularly via javascript.
  • Countdown clock or stopwatch of expiring promotion.
  • Promotion expires "soon."

The claim must be verified as true or the advertisement will be denied.

False Testimonials and Before & After Images

Any testimonials and before and after images should be truthful and authentic. If Convert2Media is informed otherwise, we will flag the offending testimonials. If a testimonial is flagged, you will need to verify the authenticity of testimonials, including before and after images, or your campaign will be denied.

Illegal Hacking

Convert2Media doesn't allow ads or websites that promote hacking by providing instructions nor equipment to illegally access or tamper with software, servers, cell phones, or websites.

Malware

Convert2Media doesn't allow the promotion of sites infected with malware, nor the sale of malicious software.

The term malware, derived from "malicious software," refers to any software specifically designed to harm a computer. Malware can steal sensitive information (like credit card numbers or passwords) or even send fake emails from a user's email account.

Misleading and Deceptive Claims

Convert2Media requires that advertisers provide transparency into the business and product that's being promoted. Convert2Media also requires that advertisers set realistic expectations about what their products and services can do for their users and not make claims that are generally deceptive or misleading and/or violate our CPC Advertiser Terms, CPA Advertiser Terms, and Publisher Terms.

Requirements

  • Don't make misleading claims
    • Promote products with realistic, credible, and reasonable claims. For example, don't promote "get rich quick" programs.
    • Provide users with accurate information about the risks associated with their product or service.
    • Include links to third-party verification and/or include relevant and easy to find disclaimers when testimonials and endorsements imply that results are typical.
    • Include links to third-party accreditation/endorsement where affiliation is implied – for example, if a website claims to be affiliated with a governmental agency, a link to verification of this affiliation should be included. Use of "gov" or "government" in display URLs and/or use of government emblems may imply affiliation with a government agency and should be verified.
  • Promote acceptable business models
    • Make it clear to users what your business does and how it works.
    • Provide a good user experience and maintain a strong online reputation.
    • Make sure that your sites display any relevant disclaimers or announcements that may be required by local law. For example, certain types of financial service providers may need to include specific text per governmental regulations.
  • Promote transparency and accuracy
    • As online advertising and local laws and regulations are constantly evolving, we can't provide an exhaustive list of the kinds of sites and ads that might be in violation of this policy. Please always emphasize the principles of transparency, accuracy, and honesty in your advertising.

Non-Weight Loss Health

Convert2Media does not allow the following elements on any claims relating to a dietary supplement, food, drug, or device not involving weight loss:

  • Any claim that is not substantiated through at least one test, analysis, research report or study that has been conducted and evaluated in an objective manner by qualified persons and is generally accepted in the profession to yield accurate and reliable results.
  • All non-weight loss health claims not including the following disclosure clearly and prominently presented, in 12 pt font or 16 pixels, 4:5 contrast ratio, stating: "Representations regarding the efficacy and safety of [product name] have not been scientifically substantiated or evaluated by the Food and Drug Administration. Click here [link out to material] to find evidence of a test, analysis, research, or study describing the benefits, performance or efficacy of [product or ingredient name] based on the expertise of relevant professionals."

Personal Information

If your website collects sensitive personal information, your site must be hosted on a secure server that uses SSL (https). The following information is all considered to be sensitive personal information.

  • Credit and debit card numbers
  • Bank and investment account numbers
  • Checking account numbers
  • Wire transfer numbers
  • National identity, pension, social security, or health care numbers

Phishing

Convert2Media doesn't allow the promotion of websites that use phishing techniques. "Phishing" is an attempt to obtain users' personal information by disguising their website to look like another website.

Provide Unique Content

Convert2Media prohibits ads that lead to websites that don't provide the user with unique and valuable content on the landing page domain.

Sale of Free Items or Services

Convert2Media doesn't allow the sale of items or services that are otherwise available for free. We also don't allow the sale of government forms or services that are available for free or for a lower price on an official or government site.

SMS Text Traffic

Convert2Media doesn't allow any web traffic on its network which is driven through the use of SMS messages promoting a free or discount offer or product.

Trade Sanctions and Restricted Parties

You cannot submit ads that, if run, would violate applicable government trade sanctions.

Trademarks and Service Marks

If a trademark owner files a complaint with Convert2Media about the use of their trademark in ads, Convert2Media will investigate and may enforce certain restrictions on the use of that trademark in ads. Convert2Media may restrict the use of a trademark within ad text. Ads using restricted trademarks in their ad text may not be allowed to run.

A trademark is anything that is used, or intended to be used, to identify the goods of one manufacturer from the goods of others. A service mark is very similar to a trademark, except that it is used to distinguish services. Trademarks and service marks include words, names, symbols and logos. Anything that distinctly identifies a company, brand or product can be a trademark or service mark.

Trial Offers

Convert2Media does not allow the following elements:

Publisher / CPC

  • Failure to include a S&H disclosure (Ex.: "S&H applies" or "Pay $___ for Shipping") and a disclosure indicating that there are additional terms (such as "See Terms for Details" or "Click Here for Details") prominently displayed close to the word "Free," where the word "Free" is used prominently or where it is used near a link to a trial offer.
  • If the word "Free" is not used next to link to a trial offer, failure to have a S&H disclosure (Ex.: "S&H applies" or "Pay $___ for Shipping") and a disclosure indicating any additional material terms if applicable.

CPA Advertiser

  • Failure to have disclosure of S&H and the other material terms (including rebill terms) of the trial offer displayed prominently and in close proximity to the credit card submit field.

Any time you are making a ``Free'' or similar offer all the terms, conditions and obligations upon which receipt and retention of the ``Free'' item are contingent should be set forth clearly and conspicuously at the outset of the offer so as to leave no reasonable probability that the terms of the offer might be misunderstood.

Convert2Media does not allow the following:

Violence and Hate

Convert2Media doesn't allow the promotion of violent or hate concepts, such as the following

  • Ad text advocating against an organization, person, or group of people
  • The promotion of self-harm and violence against people or animals

Weapons

Convert2Media doesn't allow the promotion of weapons or any devices designed to cause serious harm or injury.

Weight Loss Claims

Convert2Media does not allow the following elements on any claims relating to a dietary supplement, food, or drug involving weight loss:

  • Any claim that is not substantiated through two independent randomized placebo controlled human clinical studies.
  • Any testimonials / endorsements / first person depictions that are not verified by the person providing the testimonial via copy of the affidavit or release; by a third party (such as Verified Credible); or through a sworn affidavit by the advertiser.
  • Any claims made in any form including through ad text, images, calls to action, product labels, testimonials, endorsements, first person descriptions and before and after images, without a disclaimer in 8 pt font or 11 pixels, 4:5 contrast ratio, clearly and conspicuously in close proximity to each claim, stating, "Paid Endorsement [if applicable]; Results Not Typical; Typically reported results are _________ with diet and exercise."
  • Any claims not including the following disclosure clearly and conspicuously presented, in 12 pt font or 16 pixels, 4:5 contrast ratio, stating: "Representations regarding the efficacy and safety of [product name] have not been scientifically substantiated or evaluated by the Food and Drug Administration. Two human clinical trials suggest that ingestion of [substantiated ingredient] can lead to a reduction in weight or body fat, copies of which may be found here: [link out to trials / or cite to trials and where they may be found]. It is recommended that users follow a strict diet and exercise regimen to achieve weight loss results."

Violations of Policies

If you violate any of Convert2Media's compliance policies as defined above, the following repercussions will occur:
